COMMUNICABLE DISEASE RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

In consideration of being allowed to participate on behalf of the NPC FF Futsal Academy, event or program (the ‘Program’) including, but not limited to, events and activities, observation or use of facilities or equipment, participation in or acting as a spectator during any program(collectively ‘Participation’), the undersigned acknowledges, appreciates, and agrees that, on behalf of him or herself and any of his or her minor children:

1. I am aware there are risks of exposure to directly or indirectly arising out of, contributed to, by, or resulting from an outbreak of any and all communicable disease, including but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for Coronavirus Disease (COVID-19) and/or any mutation or variation thereof, as a result of my Participation in the Program.

2. I am aware that my Participation or that of my minor children includes a risk of possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19; and that while particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;and,

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my Participation and the Participation of any of my minor children;and,

4. I willingly agree, on behalf of myself and any of my minor children,to comply with the stated, reasonable,and/orcustomary terms and conditions related to my Participation—and that of my minor children—as regards protection against infectious diseases; and ifI observe any unusual or significant hazard during my presence or participation, I will remove myself and my minor children,as appropriate, from Participation and bring such hazard to the attention of the nearest official immediately; and,

5. I, for myself and on behalf of my heirs, assigns, personal representatives, childrenand next of kin(‘Releasors’), HEREBY RELEASE AND HOLD HARMLESS NPC FF, its officers,officials, agents, consultants, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (‘Releasees’), WITH RESPECT TO ANY AND ALLINJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or  property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted bylaw.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARENTS/GUARDIANS OF PARTICIPANT OF MINOR AGE (UNDER AGE 18 AT TIME OF REGISTRATION):

This is to certify that I, as parent/guardian with legal responsibility for the below-named minor child participant, do consent and agree to his/her release as provided above of all the Releasees, and for myselfand for the other ReleasorsI do hereby release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child’s involvement or Participation in theProgram as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.

Waiver: In consideration for the participant to be allowed to participate in NPC FF Club events, practices, training, camps or games at any facility or field used by NPC FF, for myself, for Participant and for Participant’s heir, family, personal representatives and/or assigns (collectively the “Releasers”), do hereby release, waive, discharge and agree not to sue NPC FF and all other partners, stockholders, officers, directors, employees, agents, affiliates and sponsors, collectively, the “Released Parties”, from all present and future claims for property damage, personal injury, acts of God or wrongful death arising as a result of Participant’s participation in the events, practices, training, camps or games. I understand and agree that the Released Parties are not responsible for any injury or damage arising out of the events, practices, training, camps or games, even if caused by Released Parties Negligence. 

Assumption of Risk: I understand that Participant’s participation in the events, practices, training, camps or games involves certain risks, including, but not limited to, serious injury and death. I understand and made sure the Participant understands that the Participant is voluntarily participating in the events, practices, training, camps or games with knowledge of danger involved and agree to accept all risks of participation. I represent that I understand the nature of the events, practices, training, camps or games and that the Participant is qualified, in good health, and in proper physical condition to participate. I acknowledge that if I believe events, practices, training, camps or games conditions are unsafe, I will immediately discontinue Participant’s participation in the events, practices, training, camps or games. 

Medical Authorization: I consent to administration of first aid and other medical treatment in the event of Participant’s injury or illness. 

Indemnification: I agree on behalf of the Releasers to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorneys’ fees brought as a result of Participant’s participation in the events, practices, training, camps or games. 

Severability: I understand that this document is intended to be as broad and as inclusive as permitted by the laws of the state in which the events, practices, training, camps or games are taking place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect. I further agree that any legal proceedings related to this waiver will take place in Alexandria, VA. 

Acknowledgement of Understanding: I am the parent or legal guardian of the Participant. I am of legal age and am freely signing the agreement on behalf of the Participant. I have read this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement fully, understand its terms and understand that I am giving up substantial rights, including the right to sue and any other remedies on behalf of the releasers (even if there is negligence). I acknowledge that I am signing (written or electronically) the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
